2Eligibility & account

  • You must be at least 18 years old and legally able to enter into binding contracts.
  • Business accounts must be registered by someone authorised to bind the business.
  • You must provide accurate, current information during registration and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  • We may verify your identity, business registration, tax/trade identifiers (GSTIN, IEC, EORI, VAT), and compliance status before or during the Services.
One account per business. Sharing login credentials across multiple individuals is discouraged; use separate named accounts for staff who need access.

3Our services

Subject to these Terms, Shipion will use commercially reasonable efforts to arrange the Services you request, including:

  • preparing and reviewing import/export documentation;
  • coordinating customs filing and clearance through licensed brokers;
  • booking freight, pickup, and delivery through Partners;
  • providing shipment milestones and tracking information;
  • issuing quotes, invoices, and commercial records.
Our role. Shipion acts as an intermediary and service coordinator. Physical carriage, warehousing, customs clearance, and handling are performed by Partners. Their own terms and liability limits may apply in addition to ours.

4Your obligations

You agree to:

  • provide accurate and complete shipment details — including product descriptions, HS codes, declared values, weights, dimensions, origin, and destination;
  • ensure all documentation you supply (invoices, packing lists, certificates, licences, permits) is genuine, accurate, and valid;
  • comply with all applicable export-control, sanctions, customs, tax, and trade laws;
  • have the legal right to export or import the goods, and to share any third-party data you provide (buyers, sellers, consignees);
  • properly pack, label, and mark goods to withstand normal transport conditions and to meet carrier requirements;
  • pay all duties, taxes, fees, and charges incurred on your Shipment when due;
  • respond promptly to requests for information, documents, or approvals;
  • not use the Services for any unlawful, fraudulent, or prohibited purpose.
Accuracy matters. Incorrect HS codes, values, or origin declarations can cause customs delays, fines, or seizure. You are responsible for the accuracy of your declarations to authorities.

5Prohibited goods

We do not transport, clear, or assist with the movement of goods that are prohibited or restricted by applicable law, including (without limitation):

  • illegal drugs, narcotics, and controlled substances;
  • weapons, ammunition, and military items, unless a valid licence is presented and the shipment complies with applicable export-control regimes;
  • explosives, hazardous materials, radioactive materials, and dangerous goods, except with prior written agreement and compliant packaging;
  • counterfeit goods, pirated materials, and goods infringing third-party intellectual property;
  • wildlife, endangered species, and products regulated by CITES;
  • human remains, live animals, and plants, except under approved special procedures;
  • currency, negotiable instruments, and precious metals above declared legal limits without proper authorisation;
  • items subject to sanctions, export controls, or denied-party restrictions;
  • any goods prohibited by the destination country, the origin country, or transit countries.
Severe consequences. Submitting prohibited goods may result in immediate termination, seizure, fines, and reporting to relevant authorities. You are solely responsible for any loss, penalty, or liability arising from prohibited items.

6Quotes, orders & pricing

  • Quotes are valid for the period stated and are based on the information you provide at the time.
  • Quotes may be revised if details change — including weight, dimensions, route, packaging, fuel surcharges, currency rates, or applicable taxes.
  • An order is accepted when we confirm it in writing (email or in-platform confirmation).
  • Prices are exclusive of duties, taxes, and any third-party charges unless explicitly stated.
  • All amounts are payable in the currency stated on the invoice. Bank charges and currency conversion costs are borne by you unless agreed otherwise.

7Shipment, risk & Incoterms

  • The applicable Incoterms rule (e.g. EXW, FOB, CIF, DAP, DDP) for each Shipment will be stated in the order, invoice, or commercial documents.
  • Risk of loss or damage transfers according to the applicable Incoterms rule, or as otherwise agreed in writing.
  • We may sub-contract carriage, handling, or clearance to Partners without notice to you, on terms consistent with these Terms.
  • Where regulations require, we may inspect, open, or hold a Shipment; we will inform you if this occurs.
  • Unless expressly agreed in writing, we do not provide insurance. If insurance is arranged, it is subject to the insurer’s policy terms and exclusions.

8Customs, duties & taxes

  • You are responsible for ensuring all customs classifications, values, and origin declarations are accurate.
  • You authorise us or our customs broker to act on your behalf for customs clearance purposes and to submit filings to authorities.
  • Any duties, taxes, levies, VAT/GST, or charges assessed by authorities are borne by you, unless the order expressly states otherwise.
  • If authorities require additional documents, inspections, or payments, you agree to provide them promptly.
  • Where we advance duties or charges on your behalf, you agree to reimburse us within the period stated on our invoice, plus any applicable interest.
  • Non-payment of duties or charges may result in the Shipment being held, returned, or disposed of, at your sole risk and expense.

9Delays, detention & force majeure

Transit times are estimates and not guarantees. We are not liable for losses caused by circumstances beyond our reasonable control, including:

  • weather, natural disasters, and climate events;
  • strikes, labour disputes, and industrial action;
  • customs inspections, holds, or delays;
  • carrier schedule changes, port congestion, and routing disruptions;
  • pandemics, war, civil unrest, and government action;
  • cyber incidents affecting the platform or Partners;
  • any other event of force majeure.

Detention, demurrage, storage, re-delivery, and similar charges arising from a Shipment being held at your request, or due to incorrect information, are borne by you.

10Claims & liability

10.1 Reporting claims

  • Visible damage — report within 3 days of delivery, noting damage on the delivery receipt where possible.
  • Concealed damage or loss — report within 7 days of delivery.
  • Non-delivery — report within 14 days of the scheduled delivery date.

Claims must be in writing, with supporting documents (photos, packing lists, invoices, weight notes) sent to contact@shipion.in or discussed with us on +91 63026 59565.

10.2 Liability limits

ScenarioOur liability (unless otherwise agreed in writing)

Service coordination errors Limited to the fees paid by you for the affected Service.
Partner-caused loss or damage Limited to what we recover from the Partner under its terms.
Consequential loss (lost profits, lost business, delays, etc.) Not covered.

10.3 Exclusions

We are not liable for loss or damage arising from:

  • inaccurate or incomplete shipment data, incorrect HS classification, or undervaluation;
  • improper packing, labelling, or marking by you or a third party on your behalf;
  • inherent vice, nature of the goods, or ordinary wear and tear;
  • customs seizure, regulatory action, or refusal by authorities;
  • prohibited or restricted goods, sanctions, or export-control violations;
  • carrier, port, or Partner events covered by Section 9;
  • any indirect, incidental, special, or consequential losses.

11Payment & refunds

  • Invoices are payable within the period stated on the invoice. Late payments may attract interest and suspension of Services.
  • We may require pre-payment for new accounts or high-value shipments.
  • Refunds for cancelled or failed services are governed by our Refund Policy and these Terms.
  • Third-party charges already incurred (carrier bookings, customs fees, inspection costs) are non-refundable unless we recover them.
  • All fees are exclusive of applicable taxes unless stated otherwise.

12Intellectual property

  • The Platform, its design, code, content, trademarks, and logos (including Shipion EXIM branding) are owned by us or our licensors and are protected by intellectual property laws.
  • You receive a limited, non-exclusive, non-transferable licence to use the Platform solely for your internal business purposes in accordance with these Terms.
  • You must not copy, modify, reverse-engineer, resell, or commercially exploit any part of the Platform without written permission.
  • You retain ownership of the content and documents you upload; you grant us a licence to process and share them as necessary to deliver the Services.

13Data & privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you agree to the processing of your information as described there. Where you share third-party data (buyers, sellers, consignees), you confirm you have the right to do so.

14Suspension & termination

  • You may close your account at any time via Account settings or by contacting us.
  • We may suspend or terminate your access immediately if you breach these Terms, submit prohibited goods, fail to pay, or where required by law.
  • On termination, you remain responsible for outstanding payments, incurred charges, and any shipments in progress.
  • Records that we are legally required to retain (e.g. customs, tax) will be kept even after termination, subject to our Privacy Policy.

15Disclaimer & indemnity

15.1 Disclaimer

Except as expressly stated in these Terms, the Platform and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all other warranties, whether express, implied, or statutory, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free.

15.2 Indemnity

You agree to indemnify and hold harmless Shipion, its directors, employees, and Partners from and against any claims, losses, damages, penalties, and costs arising from:

  • your breach of these Terms or applicable law;
  • inaccurate declarations, documentation, or shipment data you provided;
  • prohibited or restricted goods submitted by you or on your behalf;
  • third-party claims relating to your goods, content, or conduct;
  • your failure to pay duties, taxes, or charges when due.

16Governing law & disputes

  • These Terms are governed by the laws of India, without regard to conflict-of-laws rules.
  • The courts at our registered office in India have exclusive jurisdiction, unless mandatory law in your country requires otherwise.
  • Before starting legal proceedings, you agree to raise the dispute with us at contact@shipion.in and attempt to resolve it in good faith for at least 30 days.
  • Where mandatory international conventions apply (e.g. CMR, Hague-Visby, Montreal), those conventions may govern specific carriage disputes and their liability limits.

17Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, for material changes, provide additional notice (for example by email or an in-platform banner) before the change takes effect. Continued use of the Services after a change means you accept the updated Terms.
